    From an MLS perspective what should brokers do with respect to listings that have suffered hurricane damage?
    • First, conduct a site inspection to determine if property is in condition suitable for showings.
    • If the listed property cannot be shown to prospective buyers, listing broker may want to include a statement in the remarks section that “hurricane damage in process of being repaired; no showings pending completion of repairs”. Once repairs are completed, showings can resume. Seller should also complete a revised or new Seller Disclosure Notice describing the condition of the property.
    • If the listed property can be shown pending completion of repairs, then listing broker may want to include a statement in the remarks section that explains the damage and the repairs seller will be undertaking. Seller should also complete a revised or new Seller Disclosure Notice identifying any defects in the property.
    What impact does hurricane damage have with respect to a transaction that is set for closing?

    Section 14 of the TREC earnest money contract addresses casualty loss after the effective date of a contract. In short, seller is to restore the property to its previous condition as soon as reasonably possible, but in any event by the Closing Date. If seller fails to do so due to factors beyond seller’s control, buyer may:
    • Extend the time for performance up to 15 days and the Closing Date will be extended as necessary;
    • Terminate the contract as sole remedy and receive the earnest money; or
    • Accept the property in its damaged condition with an assignment of insurance proceeds and receive credit from seller at closing in the amount of the deductible under the insurance policy.
    What impact does hurricane damage have with respect to a property that is under contract?

    The effect of hurricane damage or other casualty loss to a property that is under contract is addressed in Section 14 of the TREC earnest money contracts. [SEE response to previous question concerning seller’s obligations to repair damage and buyer’s options if seller fails to make repairs.]

    The United Way of Greater Houston is asking anyone who would like to volunteer -- as well as those who need assistance -- in the Houston-Galveston area to call 2-1-1 Texas / United Way HELPLINE. Specialists will connect potential volunteers with local agencies in need of help.

    The Harris County Citizen Corps needs volunteers to man POD sites around Houston. To join the corps, fill out this form. Once you join, the Corps will send you an email if you are needed. www.harriscountycitizencorps.com

    The Houston Food Bank needs volunteers to put together food packages and pass them out. They say the need for volunteers will continue for weeks. Some volunteer positions can be done by children as young as 8 years old, though they need to be accompanied by an adult at all times. The food bank is located at 3811 Eastex Fwy.     The American Red Cross generally accepts only trained volunteers, but it does need bilingual volunteers who will be given onsite training. Call 713-526-8300 for more information or go to www.redcross.org.

    MD Anderson Cancer Center is in urgent need of blood and platelet donations for cancer patients. Call 713-792-7777 to make an appointment.

    The Gulf Coast Regional Blood Center says donations are especially needed now because of a four-day hiatus forced by Hurricane Ike. Click here for open donor centers.
